Moving to the UK from France
When moving personal belongings from France to the UK, several key points must be considered to ensure compliance with post-Brexit regulations:
- Transfer of Residence (ToR) Relief: This relief allows exemption from customs charges for personal belongings and home goods when you’re transferring your main residence from one country to the other. Eligibility requires you to have been resident outside the UK for at least 12 months consecutively and to be importing the goods within 12 months of your move. The goods should ideally have been owned by you for at least six months prior to importation, though exceptions exist for students and those moving due to marriage or civil partnership. Prior approval from HMRC is required, for which you can apply online (The Connexion).
- Tax and Customs Duty: Generally, moving personal belongings to the UK could incur tax and customs duty, especially if the belongings include alcohol or tobacco, which are subject to Excise Duty. It’s crucial to adhere to the regulations regarding arriving with goods, cash, food, plants, animals, importing vehicles, and sailing a boat to the UK. Failure to comply with these rules may result in the seizure of goods and vehicles, as well as fines or prosecution (Gov UK).
- Specific Conditions for Relief: For ToR relief, goods must have been in your possession for at least 6 months prior to importation, with some exemptions. The relief also covers students moving to the UK for full-time study and goods imported on the occasion of marriage or civil partnership. For students, relief is available on personal effects, household effects, and study-related items, excluding alcohol and tobacco. Gifts given on the occasion of a wedding or civil partnership, provided the giver resides outside the UK, are also eligible, with each gift’s value not exceeding £900 (Gov UK).
- Pets and Other Animals: Pets and animals brought for non-commercial purposes qualify for ToR relief. Specific guidelines exist for bringing pets like dogs, cats, or ferrets to the UK, and different rules apply to animals imported for commercial reasons (Gov UK).
- Importing Vehicles: If importing vehicles as part of your move, there are specific conditions to be aware of, including the requirement for prior notification of vehicle arrival to claim relief or pay duty and import VAT (Gov UK).
- Customs Declaration: For unaccompanied goods, a removals firm can submit a customs declaration on your behalf. If you’re accompanying your belongings, different rules apply, and VAT, as well as customs duties, may be levied if certain allowances are exceeded (The Connexion).
It’s important to ensure all your belongings are declared appropriately and any necessary taxes or duties are paid to avoid penalties.
